What is ESTA?
The Employee Sick Time Act (ESTA) in Michigan, which will take effect on February 21, 2025, mandates that employers provide paid sick leave to their employees. Under ESTA, employees will accrue one hour of paid sick leave for every 30 hours worked, and they can start using their accrued sick time after a 90-day waiting period. For businesses with 10 or more employees, the Act requires a minimum of 72 hours of paid sick leave per year, while businesses with fewer than 10 employees must provide at least 40 hours of paid sick leave plus 32 hours of unpaid sick leave. Unused sick time can be carried over to the next year, although employers can limit the annual use to no more than 72 hours. This leave can be used for the employee’s or a family member’s mental or physical illness, injury, medical care, or other related needs.
